The procedure of considering citizens’ application
The procedure for considering of citizens’ application of the Ministry of Science and Higher Education of the Russian Federation is regulated by the Federal Law “On the procedure for considering of the Russian Federation citizens’ application” of 2.05.2006 № 59-Ф3, Resolution of the Government of the Russian the Federation of 28.07.2005 № 452 “ On the standart operating procedure of the internal organization of federal executive agencies”, as well as the Instruction on the handling citizens’ applications of the Ministry of Science and Higher Education of the Russian Federation adopted by order of the Ministry of Science and Higher Education of the Russian Federation on 20.12.2018 № 1220.
Application to the Ministry of Science and Higher Education of the Russian Federation can be sent in written form and in form of an electronic document and must contain the essence of proposal, request, or complaint.
A proposal – citizen’s recommendation on improving laws and other normative legal acts, work of public bodies and local self-government bodies, development of the public relations, socio-economic and other spheres of activity of state and society.
A request – citizen’s plea for assistance in exercising of their constitutional rights and freedoms or constitutional rights and freedoms of other individuals, or reports about violation of the laws and other legal regulations, Shortcomings in the functioning of public bodies, local self-government bodies and government officials, or critics on activity of said bodies and officials.
A complaint – citizen’s plea for recovery or protection of their violated rights, freedoms and legitimate interests, or rights, freedoms and legitimate interests of other individuals.
Application received by the Ministry of Science and Higher Education of the Russian Federation is registered by the Administrative Department not later than within three days and then is sent on consideration (depending on a specified problem) to the structural bodies of the Ministry or is, within seven days from the registration date, sent to a relevant government body, executive authorities of the constituent territories of the Russian Federation which has competence to address the issue set in an application, informing the citizen who sent the application of its redirection.
An answer to an application in written form or an invoice of its redirection is sent to a postal address if it was received in written form or in form of an electronic document if it was received in an electronic document form.
In considering an application disclosure of information contained in an application, as well as data concerning citizen’s private information is prohibited without their consent. Information about personal data of applications’ that were sent in electronic form authors’ is stored and processed in accordance with the requirements of the Russian Federation’s laws on personal data.
While sending applications concerning appealing court decisions the further information should be taken in account. According to the Constitution of the Russian Federation courts alone are responsible for the administration of justice. Judiciary bodies are independent and operate independently from the legislative and executive authorities. Judicial decisions are appealed as prescribed in procedural laws.
An answer to a written or an electronic application is not given:
1) In the event that surname, name and patronymic (if there is one) of a citizen who sent an application or a mail or an e-mail address, on which response should be sent are not present;
2) A court decision is being appealed in an application (it is returned along with an explanation of procedures of appeal of this court decion;
3) An application contains obscene language or profanity, threats to life, health or property of the Ministry of Science and Higher Education of the Russian Federation officials or its territorial administrations, and member of their family;
4) In case that a text of a written application is illegible;
5) In the event that citizen’s written or electronic application contains a question that was substantively answered multiple times prior, while new arguments and circumstances are not presented;
6) In cases when substantive report cannot be given without disclosure of information that is considered to be a State Secret or other secret that is protected by law.
Information about the results of application processing is sent to the Office of the President of the Russian Federation monthly, in accordance with the requirements of the Decree of President of the Russian Federation of 17.04.2017 № 171 “ On the monitoring and analysis of the results of citizens’ and organisations’ applications processing”.
Dear users! While sending applications in form of electronic documents, please understand, that there are several restrictions, linked to handling large amounts of data:
1. Maximum size of an electronic application cannot exceed 5000 symbols.
2. If necessary, you can attach the required documents and materials in electronic form in one not archived file. Attached files cannot exceed 5 Mb. Following file formats are acceptable: txt, doc, rtf, xls, ppt, pdf, jpg, bmp, png, tiff, gif. Other file formats cannot be processed in information systems of the Ministry of Science and Higher Education of Russia.
